The military tribunal trying forty Muslim Brotherhood (MB) leaders topped by Executive office members Khairat Al-Shater and Mohamed Ali Besher, adjourned its session till Sunday, 27th, 2008. On Thursday"s session, the defence members continued pleading for the MB members facing charges of money laundry and funding the group. Lawyers Sobhi Saleh, Sayed Hassan and Mohamed Abdul Fattah resumed their pleading for Medhat Al-Haddad, Osama Sharby, Ahmed Al Nahhas, Mahmoud Abdul Gawaad, Diaa Farahat, Yasser Abdou and Gamal Shaban .

The defence team contested the decision of referring the MB leaders to the military tribunal. They also demanded subpoenaing president Hosni Mubarak.

Dr. Mahmoud Al Saqqa, a member of the defence team and a professor of constitutional law, pointed out that the decision of referring the MB leaders to the military court doesn"t have the signature of the president. He also considered the decision of referring them to the military tribunal as an evidence that the president doesn"t trust the competent normal justice.

For his part, Dr. Atef Al Banna, a member of the defence team and a professor of constitutional law stressed that lacking the signature of the president makes the decision null and void because this absent signature is a part of initial proceedings without which all the case should be dismissed.
